2. General Information on Data Processing
We only process personal data to the extent necessary for providing a functional website and our content and services. Personal data is generally only processed with your consent or where processing is permitted by law.
3. Hosting and Website Delivery (Netlify)
Our website is hosted by Netlify. Netlify processes technical connection data (server log files), in particular:
- IP address
- Time of access
- User agent / browser information
- Referrer URL
- Other technical metadata
This processing serves the secure operation and delivery of the website.
Legal basis: Art. 6(1)(f) GDPR (legitimate interest in secure, stable operation).
Third-country transfer: Data may be transferred to third countries (e.g. USA). Netlify describes international data transfers and corresponding safeguards in its Privacy Statement.
Data processing agreement: We have engaged Netlify as a data processor (DPA pursuant to Art. 28 GDPR).
Retention period: Server log files are automatically deleted by Netlify after no more than 30 days.
4. Waitlist (Netlify Forms)
When you sign up via the waitlist form, we process the data you provide to manage the waitlist and notify you when Resonate launches.
Data processed:
- Email address
- City
- Selected mode (Play or Listen)
- Optional information about musical interests
- Confirmation of being 18 or older (yes/no)
- Acknowledgment of privacy policy (yes/no)
Consent: Before submitting the form, you confirm by activating a checkbox that you have read and acknowledged this privacy policy.
Form submissions are processed via Netlify Forms. Netlify may store form submissions in its system and notify us via email. Notifications are sent to info@temme.cloud.
Recipients:
- Internal recipients (responsible staff)
- Netlify (technical processing/storage)
- Fastmail Pty Ltd. (email hosting, see section 6)
Legal basis: Art. 6(1)(a) GDPR (consent by actively signing up for the waitlist) and Art. 6(1)(f) GDPR (legitimate interest in efficient communication).
Retention period: Waitlist data is stored until the service has launched and the data subject has been notified, or until the data subject requests deletion. Netlify form submissions are actively managed by us (export/deletion).
5. Spam Detection (Akismet)
To protect against spam, form submissions received via Netlify Forms are automatically filtered by Akismet. Netlify states that all form submissions are checked for spam via Akismet.
Content data from form submissions (e.g. email address and metadata) may be processed for automated classification. For more information, see the Akismet Privacy Policy.
Legal basis: Art. 6(1)(f) GDPR (legitimate interest in preventing abuse and spam).
6. Email Hosting (Fastmail)
Our email communication is handled via Fastmail (Fastmail Pty Ltd., Level 2, 114 William Street, Melbourne VIC 3000, Australia).
Data processing agreement: We have concluded a data processing agreement (DPA) with Fastmail.
Third-country transfer: Fastmail processes data in Australia. The transfer is based on appropriate safeguards, in particular the EU Standard Contractual Clauses (SCCs) pursuant to Art. 46(2)(c) GDPR, which form part of the Fastmail Data Processing Addendum.
7. Web Analytics (Plausible Analytics)
We use Plausible Analytics, a privacy-friendly web analytics service provided by Plausible Insights OÜ (Västriku tn 2, 50403 Tartu, Estonia). Plausible collects no personal data, sets no cookies, and uses no fingerprinting. Only anonymised, aggregated usage statistics are collected (e.g. page views, referral sources, browser/OS used, country). Identifying individual visitors is technically impossible.
We use Plausible's custom events feature to measure anonymised interactions such as form submissions, button clicks, and scroll depth. These events contain no personal data — only aggregated counts and categorical properties (e.g. selected mode: "Play" or "Listen", city name, scroll percentage).
Data processing: All data is processed and stored exclusively on servers within the European Union (Germany). No third-country transfer takes place.
Legal basis: Art. 6(1)(f) GDPR (legitimate interest in anonymised analysis of usage behaviour to improve our website).
No cookie banner required: As Plausible sets no cookies and processes no personal data, no consent pursuant to § 25 TTDSG is required.

No disclosure to other third parties takes place unless we are legally obliged to do so or you have given your express consent.
9. Third-Country Transfers
Some of the service providers we use process data outside the European Economic Area (EEA):
- USA (Netlify, Akismet/Automattic): For Netlify, the transfer is based on Standard Contractual Clauses (SCCs) pursuant to Art. 46(2)(c) GDPR and the EU-U.S. Data Privacy Framework (DPF) pursuant to Art. 45 GDPR. For Akismet (Automattic), the transfer is based on Standard Contractual Clauses (SCCs) pursuant to Art. 46(2)(c) GDPR.
- Australia (Fastmail): The transfer is based on the EU Standard Contractual Clauses (SCCs) pursuant to Art. 46(2)(c) GDPR, which form part of the Fastmail Data Processing Addendum.
Data processing agreements pursuant to Art. 28 GDPR are in place with all of the above service providers.
10. Retention Periods
- Server log files (Netlify): Automatically deleted after no more than 30 days.
- Netlify form submissions: Actively managed by us; deleted after export or final processing.
- Waitlist data: Deleted after service launch and notification, or upon request by the data subject.
- Business correspondence: Retained in accordance with statutory obligations (in particular § 147 AO, § 257 HGB) for up to 10 years.
11. Fonts
This website uses only system-available fonts (system font stack). No external font services (e.g. Google Fonts, Adobe Fonts) are used. No data is transmitted to third parties for the purpose of font delivery when loading the page.
12. Cookies and Local Storage
This website sets no cookies and uses no localStorage or sessionStorage. No client-side data storage takes place.
No cookie banner required: As no cookies are set and no tracking technologies are used, no consent pursuant to § 25 TTDSG is required.
13. Social Media
This website contains no social media plugins, tracking pixels, or embedded content from social networks. No data is transmitted to social networks when visiting this website.
14. Your Rights as a Data Subject
You have the following rights regarding your personal data processed by us:
- Right of access (Art. 15 GDPR): You may request information about your personal data processed by us.
- Right to rectification (Art. 16 GDPR): You may request the immediate correction of inaccurate personal data or the completion of incomplete personal data stored by us.
- Right to erasure (Art. 17 GDPR): You may request the deletion of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defence of legal claims.
- Right to restriction of processing (Art. 18 GDPR): You may request the restriction of processing of your personal data.
- Right to data portability (Art. 20 GDPR): You have the right to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format, or to request that it be transferred to another controller.
- Right to object (Art. 21 GDPR): If your personal data is processed on the basis of legitimate interests pursuant to Art. 6(1)(f) GDPR, you have the right to object to the processing. This applies in particular to the processing of server log files and spam filtering.
